In this day and age of litigation it is important to protect your organisation and understand how best to mitigate potentially costly claims.

Clyde & Co are proud to bring you a real life trial scenario.

This is a mock trial produced by the members of the Fraud and Costs teams from Clyde and Co.

The Barristers who have kindly agreed to help are from Hailsham Chambers and Linenhall Chambers. The Barristers will be demonstrating their advocacy and cross examination skills.

Learning objectives
The objective of this workshop is to demonstrate what it is like when a claim makes it to litigation and trial.

We will have a court room set up in a very real environment and offer support and guidance after the trial on the lessons learned.

You can expect to walk away with key learning to aid in mitigating potential claims.

Itinerary
The timings of the day are as follows:-
9.30 – Coffee/Registration
10.00 – Introduction/Housekeeping
10.15 – Mock Trial commences
12.00 – Lunch (provided by the Institute)
1.00 – Mock Trial recommences
2.30 – Coffee break
3.00 – Mock Trial recommences

Speaker biographies

Damian Rourke is a Partner of the Fraud team at Clyde & Co. With extensive fraud experience, Damian is a well-known and respected practitioner in the field. He advises on fraud risk and strategy in all types of civil / criminal fraud cases, including motor, personal and commercial property, employers’ and public liability, personal accident cover and professional liability.

Oksana Hudson is a Solicitor in the Casualty and Costs Team at Clyde & Co. She specialises in all aspects of civil costs and her caseload consist of high value claims on behalf of major insurer clients and claims involving various technical challenges. Oksana works closely with insurers and public sector organisations and advises on strategies in order to successfully challenge unreasonable third party costs claims and reduce indemnity spend.

Dr Mark Friston from Haisham Chambers is a leading expert on the law of costs and is the general editor of the leading textbook on the topic. His book is frequently cited in court, both in this jurisdiction and elsewhere. Mark also often sits as a Deputy Master in the Senior Court Costs Office and also sits as a Costs Judge of the First-Tier Tribunal.

Mr James Woodcock from Linenhall Chambers specialises in personal injury litigation, including matters arising out of road traffic accidents, accidents at work and public liability cases. James’ practice includes regularly attending MOJ stage 3/disposal hearings, small claims/fast track trials and interlocutory hearings, including costs and case management conferences and infant approval hearings.

Miss Leanne Jones from Linenhall Chambers specialises in Employment, Personal Injury and Housing work. Leanne’s practice covers all aspects of personal injury work, acting for both Claimants and Defendants at all stages of litigation. Leanne has particular experience of cases arising from road traffic accidents (including cases where fraud is alleged), employer’s liability and occupiers liability. Leanne is also instructed on claims arising from negligent medical treatment and credit hire claims.
